Wine Club Terms and Conditions

1. Must be 21 years of age or older to sign up for the Spicy Vines Wine Club.

2. If wine is being shipped, an adult over 21 must be available to sign for the package. It is recommended that a business address be used for the delivery to avoid delays.

3. Wine Club member authorizes Spicy Vines to automatically bill the credit card on file for all wine club shipments and associated fees.

4. Member is required to notify Spicy Vines of any address, billing, or shipping changes prior to when account will be charged to avoid delays. Additional shipping charges will be applied to misdirected wines at the member’s expense.

5. Communication with the wine club member is done via email. Member agrees to read all emails from Spicy Vines pertaining to club shipments, events, and other club offerings.

6. Wine Club Notification Emails will be sent the week before each shipment is ready with details about the featured wines, charges to the account, how to make changes, when to expect the shipment or when it will be ready for pick up for will-call members.

7. Credit cards are charged on the day specified in the Wine Club Notification Email for each shipment month (March, June, September and December). Taxes, shipping, and handling will apply on all shipments. Spicy Vines reserves the right to delay shipping due to weather conditions that may not be ideal for the wine.

8. Spicy Vines Wine Club is a subscription and will continue until you request to cancel your membership with us. You may cancel your membership after you have purchased your initial bottles to activate your membership AND received either three (3) additional automatic quarterly shipments or one (1) additional automatic bi-annual shipment. It is the wine club member’s responsibility to notify Spicy Vines to cancel their membership via email at info@spicyvines.com prior to an automatic shipment being processed. Verbal cancellations will not be accepted. Any cancellations made prior to the fourth quarterly shipment or second bi-annual shipment may incur an early termination fee of $50 in addition to any outstanding product and shipment fees.

9. Club members understand that any purchases made prior to the shipment charge will not be counted as their shipment and the member will still be charged for the upcoming regular shipment.

10. Will-call members may pick up their wines after the credit cards have been processed on the 1st of each wine club month. Will-call orders must be picked up within 90 days of processing. Orders not picked up will be converted to a shipping order and released for delivery. Shipping and handling fees will be charged to the credit card on the account.

11. Member benefits are non-transferable. Membership is limited to (2) people. Wine club member must be present to use benefits.

12. All wine club members listed on the account authorize Spicy Vines to publish any photographs of them or their guests for use in marketing and company publications.

Wine Club Cancellation Policy

Spicy Vines Wine Club is a subscription and will continue until you request to cancel your membership with us. You may cancel your membership after you have purchased either four (4) quarterly shipments or two (2) bi-annual shipments which include the initial order and totaling twelve bottles or more. It is the wine club members responsibility to notify Spicy Vines to cancel their membership.

Shipments processed prior to cancellation are nonrefundable.

All cancellation requests must be done via email to info@spicyvines.com.

A membership is not cancelled until confirmed by a wine club representative.

Wine Club Shipping Policy

We are working hard to streamline our shipping process and improve our communications with regards to shipping orders. As we pack your order we may create a shipping label, which may send you an email notifying you that your order is being shipped. Please keep in mind that your order will be shipped on the scheduled shipping date, even if you receive this email days before. Your tracking information will be updated once your order ships.

Shipping of your wine club order may be delayed due to severe weather in our area, your area, or the route between. We will not ship if our/your weather is 85 degrees or higher. We will not ship if your weather is below 35 degrees. Orders will be held until weather permits.

An adult aged 21 or over must be present to sign for the delivery. Any shipment returned or needing to be rerouted due to an incorrect address or inability to deliver will incur additional charges.

Privacy Policy

At Spicy Vines, we recognize and respect our customers’ privacy. We are committed to respecting your privacy and recognizing your need for appropriate protection and management of contact information you share with us (the phrase “contact information” means information by which you can be contacted, such as your name, mailing address, email address, telephone number, etc.). The purpose of this Privacy Policy is to inform you what information we may collect from you, how we use such information, and the choices you have regarding our use of it, and your ability to review, correct and opt out of our use of, the information. By using our web site or sharing your contact information with us, you are accepting the practices described in this Privacy Policy.

Collecting Information About You

There may be times, such as when you purchase or order a product, when we ask you to provide certain contact information about yourself, such as your name, shipping/billing address, telephone number, email address, credit card information, birth date, gender, occupation, personal interests, and other information. We may also maintain a record of your product purchases.

Whether or not to provide such information is completely your own choice. But if you choose not to provide the information we request, you may be unable to purchase products, or access certain services, offers and content on our web sites. In addition, we may need to contact you via phone, email or mail to address questions or issues specific to your order, entry, etc., even if you have opted to not receive marketing communications from us.

In general, you can visit many of our web pages without telling us who you are or revealing any contact information about yourself. We may track the Internet domain address from which people visit us and analyze this data for preferences, trends, and site usage statistics, but individual users will remain anonymous, unless you voluntarily tell us who you are.

Confirming and tracking your order;
Analyzing preferences, trends, and statistics;
Informing you of our new products, services, and offers;
Providing you with other information from Spicy Vines, LLC and its affiliates.

To the extent necessary for such purposes, we take reasonable steps to make sure that your contact information is accurate, complete, current, and otherwise reliable with regard to its intended use. From time to time we might establish a business relationship with other persons or entities whom we believe trustworthy and whom we have asked to confirm that their privacy policies are consistent with ours. They are known as our Select Partners. In such cases we might rent, exchange, share and/or cross-reference information, including contact information about you that will enable such persons or entities to contact you regarding products and services that may be of interest to you. To serve you better, we may combine information you give us online, in our stores or through catalogs. We may also combine that information with publicly available information and information we receive from or cross-reference with our Select Partners and others. We use trust that combined information to enhance and personalize the shopping experience of you and others with us, to communicate with you about our products and events that may be of interest to you, and for other promotional purposes.

If You Purchase Alcohol

Federal and California state law requires us to request identification from each consumer to prove that you are of age to legally purchase alcohol. To process an order, we need your name, home or other physical address, including street name and name of city or town, email address, telephone number, date of birth and credit card number.

Cookies

A cookie is a piece of data stored on the end-user’s hard drive containing information of the visit to our website. The information on the cookie is accessible only to Spicy Vines and is not sold or shared under any circumstances. For your convenience, we use a cookie to store a unique session identifier, which allows us to maintain your shopping cart and personal information. We understand that sensitivity of this information and maintain our files on a secured server to protect against unauthorized access. In addition to obtaining personal information, we may collect tracking information for statistical purposes that may be disclosed to third parties. This aggregate information is for statistical purposes only. It is for understanding consumer trends and does not contain any personal information about you.

No Cancelation Policy

We have a strict no cancellation policy on all wine orders placed, unless upon receipt of your product, it arrives damaged or impaired, in which case you must follow the instructions below for Returning or Exchanging an Item. We do not offer refunds on future wine orders, as these orders are for products that are specifically produced and reserved for our customers at the time of purchase.

Returning or Exchanging and Item

If your product is damaged or impaired as a result of the manufacturer, your may return it. To return or exchange an item, please complete the following steps:
Circle the item(s) you are returning on the order form included with your purchase.
Please write the reason for the return at the bottom of the order receipt.
If you are exchanging an item, please indicate the address where you would like us to send the exchanged item if different from the original address.
Pack and seal your return item along with the order receipt.

Note: the credit used for the original purchase will be credited in the amount of the product sale. Please allow 1-2 billing cycles for the credit to appear on your bill. Shipping and handling costs are not refundable unless we have sent the wrong item.

The Sale of Alcoholic Beverages

Spicy Vines does not sell alcohol to persons under the age of 21. By using this site you swear and affirm that you are over the age of 21. Our company makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from us is over the age of 21. You also agree that any alcohol purchased from us online or by phone is intended for personal consumption and not for resale. If you do not agree with these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, our company will prosecute you fully to the extent allowable by law.

Title and Ownership

Title to, and ownership of, all wine passes from our company to the purchaser at the warehouse and state it is purchased in and the purchaser takes all responsibility for the shipping it from the warehouse to his/her home state. By arranging for transportation of the wine, our company is providing a service to, and acting on behalf of the purchaser. By utilizing this service from our company, the purchaser is representing that he/she is acting in a fashion compliant with his/her local and state laws regarding the purchase, transportation and delivery of wine. The purchaser represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered and once again authorizes that he/she is 21 years of age.
